A RESOLUTION OF THE CITY COUNCIL FOR THE
CITY OF SANTA MONICA DECLARING ITS INTENTION TO
ORDER VACATION OF PUBLIC RIGHT-OF-WAY; AND DEDICATING A PORTION OF CITY OWNED PROPERTY FOR USE AS A PUBLIC-RIGHT-OF-WAY
WHEREAS, the City of Santa Monica is the owner of certain real property described in Exhibit "A" and Exhibit "B," which it desires to develop as part of the Palisades Garden Walk + Town Square Project pursuant to plans approved by the City Council on October 25, 2011.
WHEREAS, the City of Santa Monica has determined that the public right-of-way located at Olympic Place South and the portion of the public right-of-way located at 1st Court Alley as further described in Section 1 of this Resolution and Exhibit "A" hereto is no longer needed for street use. Instead, the City seeks to utilize said property for use as a park as part of the Palisades Garden + Town Square Project.
WHEREAS, the City of Santa Monica also seeks to dedicate certain City owned property set forth in the legal description and drawing attached hereto as Exhibit "B" extending the 1st Court Alley through the parcel located at 1665 Ocean Avenue for public use as a public-right-of-way.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. After public hearing, the City of Santa Monica declares its intention to order vacation of the public right-of-way on Olympic Place South and a portion of 1st Court Alley (collectively, the "Property to be Vacated") as depicted in the legal descriptions and drawing attached hereto as Exhibit "A," and incorporated herein by reference.
SECTION 2. The City Council of the City of Santa Monica in vacating the Property to be Vacated described in Section 1 of this Resolution, elects to proceed in accordance with the provisions of the California Streets and Highways Code, Part 3, "Public Streets, Highways and Service Easements Vacation Law," Chapter 3, "General Vacation Procedure."
SECTION 3. The portion of City-owned real property set forth in the legal description and drawing attached hereto as Exhibit "B" extending the 1st Court Alley through the parcel located at 1665 Ocean Avenue is dedicated to the public for use as a public-right-of-way.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
