A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA REVISING THE FEE SCHEDULE FOR LIBRARY FINES AND USE FEES

WHEREAS, the City Council may promulgate rules for the use of City libraries pursuant to Section 1.08.030 of the Santa Monica Municipal Code; and

WHEREAS, during an analysis of neighboring library jurisdiction fees it was determined that some Santa Monica Public Library fines had not been raised in fifteen years, were much lower than the area average, library fines ensure that library materials are returned so that libraries can serve their primary purpose, and so the City desires to revise some of the established fines and fees; and

WHEREAS, it is the policy of the City of Santa Monica to charge for the full costs of services provided when such services benefit individual users rather than members of the community as a whole and the City desires to revise user fees to recover costs associated with providing black and white photocopies and printouts, placing Interlibrary loan requests and producing high resolution files on disk from the Image Archives, and;

WHEREAS, the Library Board which has charge of the administration of the Santa Monica Public Library and shall make and enforce such by-laws, rules and regulations as may be necessary for the administration, government and protection of the City Library according to Ordinance 1010 has approved of these fines and user fees.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS:

SECTION 1. All fees and fines charges by the City are hereby approved and shall remain at current levels.

SECTION 2. The following revised fees for overdue fines, user fees and Image Archives files are hereby adopted, effective July 1, 2009.

SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
