SUBJECT:  Recommendation to Authorize the City Manager to
          Negotiate and Execute an Amendment to the Professional
          Services Agreement with CMI Engineering Consultants for 
          Construction Management of the Parking Structure Nos.
          1-6 Improvement Project

Introduction 
This report recommends that the City Council authorize the City
Manager to negotiate and execute an amendment to the professional
services agreement with CMI Engineering Consultants to perform
additional construction management services for the Parking
Structure Nos. 1-6  Improvement  Project in an amount not to
exceed $48,000. 

Background

On June 25, 1996, the City Council awarded a construction
contract to Tri-Build Construction in the amount of $1,097,000
for  various improvements,  including remodeling, signage, and
graphics for the six (6) downtown parking structures (Parking
Structures, Nos. 1-6). The project includes constructing
improvements to the lobby of Parking Structure No. 5 as a
demonstration of potential upgrades that could be implemented in
the future in the remaining five (5) parking structures; up-to-date exterior signage and interior graphics that reflect the new
attendant parking arrangement; and stairwell and elevator
cosmetic work that will beautify those areas and minimize future
maintenance costs.  This work was intended to be completed within
38 weeks, working 8 hours per day. 

The City issued a purchase order on July 9, 1996 in the amount of
$49,920 to CMI Engineering Consultants for construction
management services for the Parking Structure Improvements
Project.  This purchase order was based on the Tri-Build contract
duration and work schedule of 38 weeks, 8 hours per day. 

After the start of construction, the contractor submitted a
request to work at night,  in addition to their regular working
hours,  to minimize traffic congestion and business impacts
during the holiday season.  On November 26, 1997, Council
authorized a  professional services agreement  with CMI
Engineering Consultants for additional construction management
services for improvements to Parking Structure Nos. 1-6 in the
amount of $58,000.   This contract amount was to cover the costs
of their night shift inspections. 

The project is now substantially behind schedule as the result of
delays caused by Tri-Build, which have included: insurance
cancellation by their carrier and re-issuance, lack of
coordination with subcontractors, untimely ordering of materials,
and insufficient allocation of labor resources. These delays have 
resulted in a slippage of the contract scheduled completion date 
from February 3, 1997 to May 30, 1997.  Additional construction
management services are required to extend oversight  to the new
anticipated completion date of May 30, 1997.   The anticipated
cost for the additional construction management services is
$48,000.   CMI is very familiar with the project  and soliciting
proposals from other firms at this time would substantially
interrupt project progress.  In accordance with provisions in
their contract, Tri-Build will pay for these unanticipated
construction management costs.

Budget/Financial Impact:
Funds in the amount of $48,000 are available in Account Number
01-720-263-20094-8900-99044, "Third Street Mall Improvements".   

Recommendation
Staff recommends that the City Council authorize the City Manager
to negotiate and execute an amendment to the professional
services agreement with CMI Engineering Consultants to complete
construction management services for Parking Structure Nos. 1-6
improvements, signage and graphics upgrades in an amount not to
exceed $48,000.
