Bay Saver Fee Ordinance

What is the Bay Saver fee?

The Bay Saver Fee is a conservation incentive fee assessed to all residential water customers until the property has been retrofitted with Bay Saver compliant water efficient fixtures. (SMMC 7.12.030)

How much is the Bay Saver fee?

  • Single-family dwellings  $4.00 per bill
  • Multi-family dwellings  $2.60 per unit per bill (includes apartments, condominiums, town homes)

How is the fee removed?

Replace water wasting fixtures with Bay Saver compliant water-efficient ones, then contact savewater@smgov.net or 310-458-8972 to set-up an inspection. Upon verification that all fixtures are in compliance, the fee will be removed.

What are Bay Saver compliant fixtures that allow the fee to be removed?

  • Toilets that use 1.6 gallons per flush (gpf) or less
  • Urinals that use 1.0 gallons per flush (gpf) or less
  • Sink faucets that use 2.5 gallons per minute (gpm) or less
  • Showerheads that use 2.5 gallons per minute (gpm) or less
  • Reverse Osmosis system must have shut-off valves

What Fixtures do I install if the property isn’t in compliance?

Fixtures that are not Bay Saver compliant must be replaced for the fee to be removed. New fixtures will will reflect those that are currently manufactured and available in California per the CALGreen Building Code. Please see the links below to take advantage of our programs to assist in retrofitting your fixtures!

Residential Properties

  • Toilets: 1.28 gpf or less
    • Free (pre-selected model) or Rebate (your choice of model)
  • Showerheads: 1.8 gpm or less
  • Lavatory faucets: 1.2 gpm or less
  • Kitchen faucets: 1.8 gpm or less

Commercial Properties

  • Toilets: 1.28 gpf or less
    • Free (pre-selected model) or Rebate (your choice of model)
  • Urinals: 0.125 gpf or less
    • Free (pre-selected model) or Rebate (your choice of model)
  • Showerheads: 1.8 gpm or less
  • Public lavatory hand sink faucets: 0.5 gpm or less
  • Kitchen sink faucets: 1.8 gpm or less
  • Guestroom faucets: 1.2 gpm or less
  • Metering faucets: 0.25 gallons/cycle

I had a free home assessment and passed, but I’m still being charged the fee.

Read your bill carefully. Check the dates of the billing period. Now, check the date the inspection was performed. If your inspection was performed during or after the billing period indicated on the bill, you will see the full or partial Bay Saver Fee for the days up to the inspection. If you are being charged the fee after the inspection date, please call the Water Efficiency Office at 310-458-8972.
