Re-established triennially by ordinance adoption of current editions of the construction codes. Present reference is Section
204.1 of the Uniform Administrative Code, 1998 Edition, as amended.
I. Mission Statement
The appointed appeals and advisory boards are created pursuant to Section 1002 of the City Charter. They conduct
hearings on policy and technical issues involving specific provisions of the construction codes and ordinances in Article
VIII of SMMC. They also review the updated editions of the construction codes with staff; and recommend any revisions
appropriate for City's fire, seismic, health and other public safety programs.
II. Responsibilities, Jurisdiction, Authority
The specific responsibilities set forth by ordinance concern hearing appeals from staff code
interpretation and enforcement actions "to provide for reasonable interpretations of the provisions of
these Codes, and to determine the suitability of alternates". The jurisdiction is orginial and complete for
all specific cases. They are considered to have full authority to finally resolve all "technical code
ordinance interpretation" issues for staff in specific cases by majority vote in accordance with their
standing quorum rule. This authority has not been considered to extent to granting variances or
revising specific public safety ordinance requirements.
II. Composition
The Building and Safety Commission shall be composed of five qualified members as follows: one
state registered architect, one state registered civil or structural engineer and one state licensed
building contractor, who shall serve 3-year terms; and two public members who shall serve 4-year
terms. Members shall not hold paid office within the City. (SMMC 8.08.040)
